At the recommendation of the arbitration board, the two parties have agreed that the retained purchase price portion of EUR 4.0 million agreed at the time in relation to the acquisition of the shares in WKN AG, which is still on an escrow account as stipulated in the purchase agreement, should be paid out equally to PNE WIND AG and Volker Friedrichsen Beteiligungs-GmbH. Volker Friedrichsen Beteiligungs-GmbH will remain obliged, however, to indemnify WKN AG against subsequent tax claims in accordance with the arrangements in the purchase agreement.
